Inter-changeability of Permanent Account Number and Aadhaar Number

The Union Budget presented in July 2019 had amended Section 139A of the Income-tax Act, 1961 to provide for interchangeability of Permanent Account Number (PAN) and Aadhaar number. In this regard, the Central Board of Direct Taxes (CBDT) has issued a notification no. 95/2019 dated Nov 6, 2019 to amend the Income-tax Rules, 1962 to enable quoting of the Aadhaar number instead of PAN in almost all the forms and documents as prescribed under the tax laws. Accordingly, in various income-tax forms and documents, the word ‘Permanent Account Number (PAN)’ has been substituted by the words ‘Permanent Account Number or Aadhaar Number’. This change has made it possible for a person, who is not having PAN, to furnish his/her Aadhaar number, in all those transactions where furnishing of PAN is mandatory.
