Key Updates in Goods & Services Tax – September 2019

The due date for filing of GSTR 9 & 9C extended The due date for filing GST annual return for the period from 1-7-2017 to 31-3-2018 has been extended to 30th November 2019 instead of the earlier extended date of 31st August 2019. (Order No. 7/2019-Central Tax, dated 26-8-2019). Waiver of Late Fees Payable for GSTR 1 & GSTR 6 in certain cases Central Government vide notification no. 41/2019-Central Tax on 31st August 2019 has waived the late fees payable in case of certain taxpayers (Flood affected districts of seven states and Jammu Kashmir) for the month of July 2019 in respect of Form GSTR 1 and GSTR 6 provided the said returns are filed on or before 20th September 2019. Waiver of Late Fees Payable for GSTR 7 in certain cases Central Government vide notification no. 40/2019-Central Tax on 31st August 2019 has waived the late fees payable in case of certain taxpayers (Flood affected districts of seven states and Jammu Kashmir) in respect of GSTR 7 (TDS return under GST Act) for the month of July 2019 provided the said returns are filed on or before 20th September 2019. Section 103 of the Finance Act made applicable Central Government vide notification no. 39/ 2019-Central Tax on 31st August 2019 has appointed the 1st day of September 2019, as the date on which the provisions of section 103 of the Finance (No. 2) Act, 2019 shall come into force. (Note: Section 103 of the Finance Act 2019 provides that the Government may disburse the refund of the State Tax in such manner as may be prescribed). ITC 04 (Intimation of Goods sent and received to/from Job worker a waived Central Government vide Notification No. 38/ 2019-Central Tax has waived the filing of Form ITC-04  (form required to be filed for Goods sent and received back from Job worker ) for the period July 2017 to March 2019. However, goods sent in the said period but not received from a job worker or not supplied from the place of business of the job worker as on the 31st March 2019, will be reported in ITC 04 for the period of April 2019 to June 2019 in serial number 4 of the said form. The due date for filing of GSTR 3B extended Central Government vide Notification No. 37/ 2019-Central Tax has extended the due date for filing of GSTR 3B (monthly summary return) for the month of July 2019 to 22nd August 2019. Earlier the due date was 20th August 2019. Further, the due date for filing of GSTR 3B for the persons having a principal place of business in the state of Jammu & Kashmir and other specified districts will be 20th September 2019. Restriction on E-way Bill Issuance relaxed till 21st November 2019 Central Government vide Notification No. 36/ 2019-Central has postponed the date of applicability of Rule 138E to 21st day of November 2019 from existing 21st day of August 2019. Rule 138E provided that if a registered dealer is failed to file GST Return for consecutive two tax periods, there would be Restriction on furnishing of information in PART A of FORM GST EWB 01. Not only the taxpayers themselves but even the other person would not be able to generate on such taxpayers’ behalf. This rule will be now applicable from 21st day of November 2019. Sabka Vishwas – Legacy Dispute Resolution Scheme, 2019 The Sabka Vishwas – Legacy Dispute Resolution Scheme, 2019. The Scheme has been notified and is operational with effect from 1st September 2019. This Scheme would continue till 31st December 2019. The intention of the Government is to free the taxpayers from the burden of litigation and investigation under the erstwhile laws of Central Excise, Service Tax, etc. It is expected that the Scheme would be availed by a large number of taxpayers for closing their pending disputes relating to legacy Service Tax and Central Excise cases that are now subsumed under GST. The Government is slated to make this scheme a great success and therefore full support is expected from the Tax Officials.
