1. WHAT INFORMATION DO WE COLLECT?

In Short: We collect personal information that you provide to us such as name, address, contact information and company information.

These Regulations have become effective from May 28, 2018. Few of the important aspects of the Regulations are summarized hereinafter:

Objectives of GDP Regulations 

The Regulation has the following objectives:           

  • Protects fundamental rights and freedom of natural persons, in particular, their right to protection of their personal data;
  • Free movement of personal data within the union, it can neither be prohibited nor restricted for reasons of protection of natural persons;

Geographical Reach and Applicability

The Regulations applies to:

  • This Regulation applies to the processing of personal data wholly or partly by automated means or otherwise.
  • a person who processes personal data for its utilization in its activities and to the person who processes such personal data within the European Union;
  • the processing of personal data of persons who are in the European Union, whether the controller of such data or the processor is within the European Union or not, if such processing is related to:

(a)     the offering of goods or services, irrespective of whether a payment of the data subject is required, to such data subjects in the Union; or

(b)    the monitoring of their behaviour as far as their behaviour takes place within the Union.

  • the processing of personal data by a controller not established in the Union, but in a place where Member State law applies by virtue of public international law.

Regulation does not apply to protection of personal data when:

  • in course of activity which falls outside the scope of European Union law.
  • by the member states when carrying out activities which are specifically stated to be outside the scope of European Union.
  • by a natural person in the course of purely personal or household activity.
  • by government authorities for the purposes of prevention, investigation, detection or prosecution of criminal offences or the execution of criminal penalties including the safeguarding against and the prevention of threats to public security.

Principles for processing

The following principles should be considered for processing of the personal data of the data subject:           

  • it should be processed lawfully, fairly and in a transparent manner in relation to individuals;
  • it should be collected for specified, explicit and legitimate purposes and not further processed in a manner that is incompatible with those purposes;
  • processing of data for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes shall not be considered to be incompatible with the initial purposes;
  • the data should be adequate, relevant and limited to what is necessary in relation to the purposes for which they are processed;
  • every reasonable step must be taken to ensure that personal data that are inaccurate, having regard to the purposes for which they are processed, are erased or rectified without delay.
  • kept in a form which permits identification of data subjects for no longer than is necessary for the purposes for which the personal data are processed;
  • personal data may be stored for longer periods insofar as the personal data will be processed solely for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes subject to implementation of the appropriate technical and organizational measures required by the GDPR in order to safeguard the rights and freedoms of individuals.
  • data has to be processed in a manner that ensures appropriate security of the personal data, including protection against unauthorized or unlawful processing and against accidental loss, destruction or damage, using appropriate technical or organizational measures.

Consent – Whose & How

The Regulations provide that the Consent of the data subject is necessary for processing the data and following should be considered while taking the consent:

  • consent under the GDPR must be a freely given, specific, informed and unambiguous indication of the individual’s wishes:
  • there must be some form of clear affirmative action – or in other words, a positive opt-in – consent cannot be inferred from silence, pre-ticked boxes or inactivity;
  • consent must also be separate from other terms and conditions, and you will need to provide simple ways for people to withdraw consent;
  • public authorities and employers will need to take particular care to ensure that consent is freely given.

Children’s Personal Data

The Regulations contain new provisions intended to enhance the protection of children’s personal data which are stated hereinafter:

  • privacy notices for children should be written clearly and in a plain manner which is understood by children;
  • online services offered to children would require consent from a parent or guardian to process the child’s data;
  • if consent is the basis for processing the child’s personal data, a child under the age of 16 can’t give that consent themselves and instead consent is required from a person holding ‘parental responsibility’.

Individual Rights

The Regulations provides the following rights for individuals:

  • The right to be informed
  • The right of access
  • The right to rectification
  • The right to erasure
  • The right to restrict processing
  • The right to object
  • The right in relation to automated decision making and profiling.

Applicability?

The Regulations applies even if the data is concerning persons who are within European Union irrespective of the fact where the person for whom data is processed and who processes the data;

The Regulations also applies if data is concerning monitoring of the behavior of a data subject within the European Union;

If because of either of the aforementioned requirement, these Regulations are applicable, a consent would have to be obtained, in a manner which is explicit, from the person to use data related to him for a particular purpose.

The data subject also has certain rights such as erasure of data, restricting of processing and object to the processing of his data. These rights have to be made available to him and any non-compliance would result in damages.

Any dealing with children would require consent from their parents or guardians.

7. HOW LONG DO WE KEEP YOUR INFORMATION?

In Short: We keep your information for as long as necessary to fulfill the purposes outlined in this privacy policy unless otherwise required by law.

We will only keep your personal information for as long as it is necessary for the purposes set out in this privacy policy unless a longer retention period is required or permitted by law (such as tax, accounting or other legal requirements). No purpose in this policy will require us keeping your personal information for longer than 2 years.

When we have no ongoing legitimate business need to process your personal information, we will either delete or anonymize it, or, if this is not possible (for example, because your personal information has been stored in backup archives), then we will securely store your personal information and isolate it from any further processing until deletion is possible.
