    Protecting Intellectual Property Rights in Qatar

    Intellectual property rights (“IPR”) have always played an inherent role in breakthrough discovery in various fields. In Qatar, preserving innovation is valued highly, with businesses and individuals striving to make developments in various fields. Qatar has consistently strengthened its legal framework and incorporated strategic policies to protect Intellectual Property (“IP”) and combat counterfeiting, building a robust IP regime in line with its Qatar National Vision 2030, which emphasises the transition towards a knowledge-based economy.

    Qatar is a signatory to various international treaties relating to the recognition and enforcement of Intellectual Property Rights, including the Paris Convention for the Protection of Industrial Property on patents and trademarks, the Patent Cooperation Treaty (“PCT”) for patents, the Agreement on Trade-Related Aspects of Intellectual Property Rights (“TRIPS”), the Berne Convention for the Protection of Literary and Artistic Works for copyright, and has recently acceded to the Madrid Protocol Relating to the Madrid Agreement Concerning the International Registration of Marks for international trademark registration.

    What are Intellectual Property Rights?

    Intellectual property rights are legal rights granted to individuals over creations of the human intellect, conferring upon them the exclusive right to exploit those creations and combat unauthorized use. Under Qatari law, IPR comprises various kinds of rights, including:

    • Patents (governed by Qatar Decree-Law No. 30/2006 on Patents Law);
    • Trademarks (governed by Qatar Law No. 9/2002 On Trademarks, Commercial Indications, Trade Names, Geographical Indications and Industrial Designs);
    • Copyrights (governed by Qatar Law No. 7/2002 On the Protection of Author’s Rights and Related Rights); and
    • Industrial Designs (governed by Qatar Law No. 10/2020 On the Protection of Drawings and Industrial Designs ).

    How To Protect IPR?

    If a third party attempts an unauthorized use of your intellectual property rights or exploits the same for their commercial advantage, you must have safeguards in place to combat such theft. The best way to protect IPR in Qatar is to register it with the Ministry of Commerce and Industry (“MOCI”), which administers IP registration through its dedicated Intellectual Property Rights Protection Department (“IPRPD”), and to enforce your ownership rights when used without authority. It is important to note that Qatar operates on a first-to-file basis for patents and trademarks, meaning timely registration is critical. The other ways of protecting IPR include having in place confidentiality agreements, strong Non-Disclosure Agreements, and implementing appropriate security measures.

    Benefits Of Protecting IPR

    • Protect your unique creations: protect your IP against infringement and unauthorized use by others, and defend your exclusive right to use, sell, or license your IP rights before the Qatari courts and competent authorities.
    • Enhance the market value of your business: having registered and protected IP rights can increase the goodwill of your business and strengthen your overall commercial standing in Qatar’s growing economy.
    • Additional Income: IP assets can be monetized and commercialized through sale and licensing, resulting in increased revenue and a consistent source of royalties that can accelerate the growth of your company. Qatar’s legal framework ensures that licensing agreements and royalty arrangements are enforceable.
    • Reputation among consumers: having registered and protected IP assures consumers that they are purchasing safe and guaranteed products, which builds reputation and loyalty in the market.
    • Border Protection: IP rights recorded with the Qatar General Authority of Customs, under Qatar Law No. 17/2011 Concerning Border Measures on Intellectual Property Rights, enable the active detention and seizure of counterfeit or infringing goods at Qatar’s ports of entry, preventing them from reaching the market.

    Enforcement Of IPR

    Infringement or misappropriation occurs when another party seeks to violate your intellectual property rights. Depending on the type of IPR protection infringed upon and the degree of the violation, IPR violations in Qatar are either civil or criminal offences under the relevant IPR statutes and Qatar Law No. 11/2004 On the Issuance of the Penal Code. In the event that IP rights are violated, the owner may seek redress through civil proceedings before the Qatari courts, including injunctions, damages, and seizure orders; or through criminal proceedings where wilful infringement is involved. Administrative remedies may also be pursued through the IPRPD at MOCI, which has the authority to investigate complaints and take enforcement action.
