An Update on Corporate Tax Registration in UAE

In line with the Federal Decree-Law No. 47 of 2022 – “Taxation for Corporations and Businesses”, the Federal Tax Authority (“FTA’”) has announced that the registration process shall be made on Corporate Tax (CT) registration portal on EmaraTax. The FTA has also issued an official invitation to early registration for Corporate Tax to certain individual legal entities informing them that another private email invitation will be sent across to them which will include a link to the registration portal and enable them to carry out the registration procedure. As of now, the registration is being done for selective entities by invitation and the registration link is not meant to be circulated to anyone else. It is learned that the early registration period is available from January 2023 to May 2023 for certain categories of companies operating in the UAE who will be receiving invitations by FTA to register through the EmaraTax platform.

When the registration opens, priority will be given to companies and businesses that have a financial year starting 1st June 2023.  The registration process for Tax Group and Natural persons will commence at a later date.

The FTA has also recently issued a Corporate Tax Registration Manual to help Taxpayers navigate through the portal and submit the Corporate Tax registration application. The manual serves as a guidebook dealing with the process to be adopted for the registration process over different tabs with a brief description of information, documents, etc., to be uploaded for completion of the CT registration application. Upon successful submission of the application, the applicant company shall be issued acknowledgment which will follow either additional information notification if some more information is required by FTA or approval/ rejection notification as the case may be.

The Manual clarifies that if any Taxpayer has branches, the registration will be in the name of the Head Office and not in the name of the individual branch.  It also mentions that if there are branches in more than one Emirate, only one CT registration is required. It also states that any foreign business applying to register for Corporate Tax may choose to appoint a tax agent in the UAE.  The FTA will be providing more information on registration for Corporate Tax in due course of time.
