    Penalties: Before vs After Audit

    Penalties are revamped with effect from 14th April 2026, therefore, it is critical to analyse whether it is beneficial to avail early voluntary disclosure filing or delay the same. This is where a VAT health check becomes critical to assess and evaluate exposure, if any.

    With effect from 14 April 2026:

    If errors are found after an audit begins:

    • Fixed penalty of 15% on the tax difference, and a monthly 1% on the tax difference, for each month or part thereof.

    If errors are identified before audit and a Voluntary Disclosure (VD) is filed:

    • Businesses can rectify mistakes voluntarily with much lower penalties.
    • As per recent Cabinet Decisions (Effective from 14th April 2026), penalties reduce to as low as 1% per month on unpaid tax if disclosed voluntarily before notification of audit.
    • Acting early protects your reputation and demonstrates proactive compliance.

    Incorrect returns will result in penalty of AED 500 per VAT return except where no changes in VAT due amount.
