Safeguard your loved ones with a will registered in the UAE
The subject of wills is an important one for expats in the UAE. Wills registered in the UAE are essential to securing and protecting their assets held in this country. Of late, with the realization that the Covid pandemic may stretch longer and that the young are not immune, demand has increased, and the average customer age is now lower.
Although the laws are beginning to recognize and allow wills registered in a foreign country, such wills are not sufficient to safeguard the properties, land, buildings, shares, or other assets held in the name of the expatriate. For this, a will must be registered at ADJD (Abu Dhabi), Dubai Courts or DIFC.
Moreover, we are often asked if a power of attorney (representative) can sign on behalf of the testator (person whose will is being prepared) when expats have purchased property or hold shares in companies in the UAE. We are clear about this: it is in the best interest of the testator to be present to sign the will in person. This ensures that the probation process does not face any unexpected issues when completing procedures at the court and ancillary authorities.
Our experience tells us that for an expat living, earning, and purchasing assets in the UAE, registering a will in the UAE at the earliest is the most necessary and prudent course of action, especially for those with children. That is an assurance that their loved ones will be cared for in the event of their demise.
