FSSAI Updates
The Food Safety and Standards Authority of India (“FSSAI”) on the 31st day of August 2022 issued a notification for the purpose of amending the Food Safety and Standards (Prohibition and Restrictions on Sales) Regulations, 2011 (“Regulations”) by amending the following provision:
- Regulation 2.3.14, which provides, restrictions relating to conditions for sale; under which, clause (4) which earlier prohibited any person to manufacture, sell, store or exhibit for sale, an infant milk food, infant formula, and milk cereal-based weaning food, processed cereal-based weaning food and follow up formula except under Bureau of Indian Standards (BIS) certification mark.
- The abode clause (4) has now been modified by the amended Regulation to prohibit any person to manufacture, sell, store or exhibit for sale food for infant nutrition, except under the BIS certification mark, wherever BIS standards are available.
- In simpler words, the amendment has removed any classification of food for infants covered in the Regulations and replaced it with all food for infant nutrition, to obtain the BIS certification mark.
These amended Regulations will be effective from 01st April 2023
