Companies (Removal of Names of Companies from the Register of Companies) Amendment Rules, 2022

Ministry of Corporate Affairs (“MCA”) vide circular/notification dated 9th June 2022 has issued “Companies (Removal of Names of Companies from the Registrar of Companies) Amendments Rules, 2022” for the purpose of amending the Companies (Removal of Names of Companies from the Registrar of Companies) Rules, 2016 (“Rules”).
By virtue of the above amendment, MCA has revised the procedure for striking off a company as under:
- Registrar is now empowered to call for additional information/ documents upon examining the application made in Form STK-2, in case it is found out that such application or any document is defective or incomplete in any respect;.
- Registrar is now empowered to grant an additional period of 15 days of resubmitting the form STK-2 if the Registrar finds that the Form or document is defective or incomplete in any respect.
The above said amendments are however not applicable on any re-submission of the application in Form STK-2 made prior to these amended Rules.
Further, by virtue of this amendment, MCA has also revised the formats of Form STK-1, Form STK-5, and Form STK-5A.
