Ministry of Home Affairs ( MHA ) Notifies Amendments to FCRA Rules 2022

Ministry of Home Affairs (“MHA”) had on the 01^st day of July 2022 issued a notification for the purpose of amending Foreign Contribution (Regulation) Rules, 2011 (“Rules”) by amending certain provisions which are produced as under:-

• Under rule 6 of the Rules monetary limit of receiving foreign contributions in excess of one lakh rupees has been increased to ten lakh rupees in a financial year and also, the time frame required to inform the Central Government regarding the details of the foreign contribution has been increased from one month to three months from the date of receipt of such contribution;
• Under rule 9 (1) (e) of the Rules which provides for application for obtaining 'registration' or 'prior permission to receive a foreign contribution, the timeframe of intimating the MHA of opening one or more accounts for the purpose of utilizing the foreign contribution has been increased from 15 days to 45 days;
• Under rule 9 (2) (e) of the Rules also, the timeframe of seeking prior permission under this rule for opening one or more accounts for the purpose of utilizing the foreign contribution after it has been received and intimating the MHA has been increased from 15 days to 45 days;
• Under rule 17 A of the Rules which provides for any change in a designated bank account, name, address, etc. the timeframe for intimating the MHA has been increased from 15 days to 45 days;
• Under rule 20 of the Rules which provides for revision by the competent authority under the Rules, the mode of presenting application has been changed from plain paper to any such form and manner, including in electronic form as may be specified by the Central Government;
