The Haryana Government, vide Labour Department Gazette Notification No. 02/26/2026-2Lab dated May 4, 2026, has exempted every “Establishment” situated in the State of Haryana and registered under Section 3 of The Occupational Safety, Health and Working Conditions Code, 2020 (“OSH Code”), upon finalization of the Haryana Rules, from the requirement of obtaining Registration or Intimation of Business Commencement under Section 13 or Section 13A of the Haryana Shop and Commercial Establishments Act, 1958.
The main objective of this exemption is to avoid duplicacy of registration and compliance processes. Prior to this notification, establishments were required to register separately under both the Shops & Establishment Act and the OSH Code.
However, it is important to note that all establishments must continue to comply with other applicable provisions of the Haryana Shop and Commercial Establishments Act, 1958, to the extent that they are not inconsistent with the OSH Code.
